What to put in a lease renewal letter
- When the current lease ends and the dates of the new term.
- The rent for the new term, and whether it changes.
- Any other changes, such as utilities or pet rules.
- A reply-by date, and what happens next: you send the renewal lease to sign, or the tenant gives notice to move out.
When to send it
Send the offer 60 to 90 days before the lease ends. That gives the tenant time to decide and you time to find a new tenant if they leave. If the renewal raises the rent, the state notice rules for increases apply: for example, New York requires 30, 60 or 90 days' notice for an increase of 5% or more, depending on how long the tenant has lived there (Real Prop. Law § 226-c), and California's notice periods are in Civil Code § 827.
Is a renewal letter the same as a new lease?
No. It is an offer. Once the tenant accepts, both of you sign a renewal lease or a lease extension.
What if I do not want to renew?
Some states and cities require written notice of non-renewal and limit the reasons for it. Check the rules for your property before you send one.
These letters are templates for routine landlord communication, not legal advice. State and local rules change; check the current law for your property before you rely on a notice.
