Notice to vacate
End a month-to-month tenancy or confirm a lease will not be renewed, in writing. Tenants can use it too, to tell the landlord they are moving out. The tool counts the days of notice you are giving.

What a notice to vacate should say
- Who it is from and to, and the rental address with unit number.
- The date the tenancy ends, far enough ahead to meet the required notice period.
- The reason, where your state or city requires one.
- Next steps: returning keys, the move-out inspection, and a forwarding address for the security deposit.
How much notice is required
Examples, checked against the statutes in October 2026:
| State | Rule | Source |
|---|---|---|
| California | Landlord: 30 days if the tenant has lived there less than a year, 60 days if a year or more. Tenant: at least the rental period (30 days for month-to-month). | Civil Code § 1946.1 |
| California | After 12 months of tenancy, most landlords need a just cause stated in the notice; no-fault causes (such as the owner moving in) require relocation help of one month's rent. | Civil Code § 1946.2 |
| Florida | Month-to-month: at least 30 days before the end of a monthly period, from either side. Week-to-week: 7 days. | Fla. Stat. § 83.57 |
| New York | Landlord not renewing: 30 days (under a year), 60 days (one to two years), 90 days (two years or more). | Real Prop. Law § 226-c |
A notice to vacate is not an eviction
This notice ends the tenancy on a date. If the tenant does not leave, the landlord must go to court; changing locks or removing belongings is illegal in every state. Notices for unpaid rent or lease violations have their own forms and shorter deadlines; see the late rent notice page for those rules.
How should I deliver it?
Follow your lease and state law. Hand delivery or certified mail with a copy kept for your records is the common safe choice. Email alone may not count as written notice.
Can a tenant give a 30-day notice in the middle of a lease?
Usually not without consequences. A fixed-term lease binds both sides until it ends, unless the lease or state law allows early termination.
This letter is a template for routine landlord communication, not legal advice. Check the current law for your state and city before you rely on it.
